My only advice is not to use an oil change company. The number of 
stories like this that I've heard, while probably small as a percentage 
of the customers serviced, menad the risk is too great for me to risk 
even the least valuable vehicle I own in the hands of someone with just 
enoguh skills to change oil.

I would guess that you need to get a lawyers opinion, and possible his 
serivces to sue. I wouldn't bet on the oil change company doing the 
right thing. They didn't in the first place.
