It's set by the individual states, but generally only as an acceptable
range. Here in California, to be called 'beer', it must be between 0.5% and
4% alcohol by weight. Anything 4% or above must be called something else
like "malt liquor" or "ale". Some states limit beer to 3.2% by weight
(sometimes called "near beer").
