Close, derf, but not exactly right. It is a "Title 2" weapon. "Class 3"
refers to the dealer.
The law reads that you must have a tax stamp to "possess" a Title 2 weapon.
It is a pretty valid argument that, if you are holding it and shooting it,
you are "possessing" it. If you have a bag of dope in your pocket and the
owner of that dope is standing next to you, you can still be charged with
"possessing" the dope. Trust me on this. At $250,000 and 10 years, I don't
think I would be splitting too many hairs with these guys. They can
seriously f___ with you if they want to. And they get paid to do that.
All this being said, I can't imagine what kind of law-abiding citizen
"needs" to have a silencer. It seems to me that they should be illegal
everywhere. And save your BS 2nd amendment arguments, it doesn't apply.

Buying or making a silencer for an individual requires the same
paperwork. A Class 3 manufacturer can make and sell them.
You can let others shoot a silencer or other Class 3 weapon (like full
automatic guns). But, you have to be with them. You can't loan it to
anyone or let anyone take it somewhere that you are not.
The stamp is an actual stamp, like a postage stamp. The $200 price
for the stamp has not changed since 1934. At that time it was priced
to keep most people from being able to afford the stamp.
Like switch blade knives, silencers/suppressors are legal in some
states and illegal in others. Check your local laws. Even if legal
in your locale, manufacture is against Federal law unless you have a
completed Form 4 or unless you are a licensed Class 3 firearms
manufacturer.
By definition anything made to be attached to a firearm and to lessen
the sound of firearm's report is a silencer. If you tape a 20oz soda
bottle to the end of a gun (effective, BTW) then you have made an
illegal silencer.
