While I, as a sometime writer, tend to agree with the lack of ethics in using
someone else's writing without their permission or without giving credit, if
there was no copyright on the material, then there was no copyright
violation. Really the only way to protect written materials is to copyright
it. Was there, in fact, a copyright on the material? Did Frank, in fact,
give permission for the mag to use the material? I am unclear to either
question.
