Can they *do* that? Most regions just stick nonmembers with a hefty
surcharge.

Sure they can. And the #1 reason for doing it is called the Internal
Revenue Service.
The IRS likes to sack you big time for being a "non-profit"
club/organization and charging two different (member & non-member) entry
rates to events. Many regions have suffered sleepless nights and greatly
diminished (funds confiscated or frozen) bank accounts while attempting to
straighten the mess out.
