I just went out to the garage and sat in the seats... my passenger seat 
feels just as rigid as the driver's seat even with me trying to wiggle 
in it.   Are you sure you don't have something loose or weakened?

I sure wouldn't want to weld it up... having that seat fold forward when 
the tonneau is on is very handy.  An added bonus of the hinged seat is 
that it can be 'adjusted' to a more upright position if desired by 
introducing a couple of  shims on the two metal pads on the back lip of 
the seat bottom.   I used 2 pieces of wood about 3/16" thick.
