I am sure both are correct, depending upon whom you are talking to.
Functionally, you are correct. From the state's viewpoint it is a piece
of pollution control equipment, and a valve, that must legally be on the
car and functioning. So they think, by legislation, that it is one of
the Pollution Control Devices mandate. In fact, the first one.
