Far be it to flame someone, especially on an issue that has been so
misrepresented as to confuse even the most diligent of "studiers" of the
AQMD, the Smog Police, the pollution businesses, and the politicians.
These people have all found a way to make it easier on themselves and also
profitable by making this issue so "un-understandable".  Hell, even the
people (read bureaucrats) that have written the law aren't exactly sure what
it says.
Businesses make money by delaying the cleaning up of their own house by
buying and selling smog credits.  They (the oil companies) get these smog
credits by buy your "GROSS POLLUTER". 
The gross pollution guidelines aren't totally in place yet, but if the major
players in this game have their way,  any automobile older than 5 years will
probably be in violation of this law (time frame is my opinion although
echoed by others).
"The State Implementation Plan (Smog Chcek II) has changed the previous law
that stated 'The following vehicles are exempt', to 'CURRENTLY, the
following vehicles are exempt'.  The exemptions under both laws are listed
as: vehicles manufactured prior to 1966 model year, diesel vehicles,
motorcycles, two cycle engines and engines having less than 50 CID.
Later in the SIP it is stated that the "Bureau" shall estamblish standared
for all registered vehicles.  DMV codes require registration for all
vehicles housed within the State.  This means that standards are being
developed for all classic cars as well as standard (newer) cars."
The preceeding paragraph was taken from a news letter written by the ATA.
If you would like some good information on what all is going on I'd suggest
that you contact the Automotive Technicians Association at (310)602-1018,
or Stop Smog II at (800)991-1918 and get on their mailing list.  These guys
are working very diligently to make sure that whatever law is finalized is
fair to all and not just a few in the inner circle of politics.
