Here's the latest in the fateful Flounder saga...
I'm searching for paperwork... as I have a letter from the restorer
indicating I had paid him in full.
I will have a statement sworn by someone else who's done business with the
restorer. He was also present when the restorer was paid the final sum, and
witnessed the discussion. He is/was also waiting years for him to complete
a project. We always knew this guy would be extremely late on his work, but
never suspected he would try this shit.
I will meet the Allegan County Sherriff at the restorer's shop, with my
documentation, so that they may hear "his side" of the story.
The detective will then present the facts to the District Attorney, who will
either agree to press charges, and/or instruct the sherriff of Allegan, in
conjunction with the sherriff in Grand Rapids to accompany me to where the
"purchaser" now has the hull and seats. (The motor, trans, gas tank,
dashboard, gauges, steering, and trailer are in my possession) They will
instruct him to release it to me as it's my property. The restorer would be
charged with "larceny by conversion". The guy who "purchased" the boat would
have to bleed the restorer to get his money back (fat chance).
If the District Attorney decides not to pursue in "criminally", it then
becomes a civil matter. I'll have to sue the restorer and the "purchaser'.
Either way, while in the area, I will hire an attorney to represent me
locally.
Judy Cull suggested I speak to Joe Moch, but he is unavailable for a few
weeks.
