I have already sent mail to TRF but I thought the net would like to know this
information as well.
Misdeclaring the parts as for your car can lead to the following penalties:
1) Seizure of the part and fines equal to the duties and taxes you would
have paid anyway.
or in more serious cases
2) Minimum $200 fine up to a maximum $2,000 fine or up to 6 mths in jail
or BOTH.
or in indictable offense cases
3) Minimum $200 up to a maximum of $25,000 fine or up to 5 YEARS in jail
or both.
While in most cases customs will let you pay the duties and taxes, you should
know this is a serious offense...especially if they can prove fraud.
The more likely outcome of TRF issuing misleading statements is their
shipments to Canada could be put under harder scrutiny and therefore shipments
to more HONEST Canadians would be delayed.
Basically I advised TRF to put the statement on only if they know the part can
actually be put on a car of the vintage the client claims it is for. ie dont
declare the alternator for a 76 MGB to be for a car or earlier vintage. IF
the part could be for a vintage car then it is up to the importer to deal with
the conswquences of misdeclarations.
My apologies to our US friends who don't have to deal with this stuff. My
exhaust manifold for my 75 Midget cost $175 US from Special Interest and I had
to tack on $70 Canadian for duties and taxes. 8(
BTW...SI did not tell me that the Midget 1500 exhaust manifold is only for a
post 76 midget, anybody know if it can be used as a replacement, the EGR valve
is on the opposite side of the flange. Or do i just have to send it back?
